TOUR BOOKING TERMS AND CONDITIONS WITH GO2NEWZEALAND 2019 LIMITED

Any instructions received by Go2NewZealand 2019 Limited (Go2NewZealand) from the customer shall constitute acceptance of the terms and conditions contained herein. The terms below apply to all work and services we provide, except where otherwise agreed in writing.

Should a tour be cancelled due to the New Zealand Government imposing further covid-19 travel restrictions, Go2NewZealand will take all reasonable steps to notify you and arrange for any deposit paid to be transferred to a future tour date of your choice.

If a tour is not affected by Covid-19 travel restrictions, our standard terms for cancellation apply.

1. COLLECTION AND USE OF INFORMATION

1.1 The customer authorises Go2NewZealand to collect, retain and use any information about the customer, or for the purpose of assessing the customer’s credit worthiness, or for enforcing any rights under this contract.

1.2 The customer authorises Go2NewZealand to disclose any information obtained to any person for the purposes set out in clause 1.1.

1.3 Go2NewZealand reserves the right to use photographs or videos taken during tours for promotional purposes. This may include but is not limited to, use online, in printed material or at public events.

1.4 Where the customer is a natural person the authorities under clauses 1.1 and 1.2 are authorities or consents for the purposes of the Privacy Act 1993.

2. NO OBLIGATION TO ACCEPT BOOKINGS

2.1 The placement for a booking for tour services will for all purposes be deemed to be accepted by the customer of these terms.

2.2 At no time will Go2NewZealand be obliged to accept any request to supply tour services and Go2New Zealand reserve the right to refuse any request from a potential customer at any time.

2.3 Go2NewZealand may at its sole discretion impose further terms and conditions prior to undertaking any tour as may be required by law or health and safety regulations.

3. PRICE

3.1 Unless stated otherwise, any price is an estimate (Estimate) on a plus GST basis and in New Zealand dollars. The quote is subject to clause 4 below.

3.2 The Estimate is open for acceptance for fourteen (14) days’ from the date it has been issued unless withdrawn by Go2NewZealand prior to receipt of acceptance.

3.3 Where no price is stated in writing or agreed to orally, any tour booking shall be deemed to be accepted at the current price advertised by Go2NewZealand.

3.3 The price may be increased by the amount of any reasonable increase in the cost of services that is beyond the control of Go2NewZealand between the date of the quote provided or the date of the tour.

3.4 Any holiday prices are based on schedules, fares and tariffs current at the time of enquiry and receipt of quotation. Go2NewZealand reserves the absolute right to vary any tour price as a result of current fluctuation, or component cost increase. Tour costing will be guaranteed at the price prevailing at the date of final payment.

3.4 The customer must pay the prices charged.

4. PAYMENT

4.1 The non-refundable deposit, being 20% of the tour cost secures your booking and acknowledgement of our terms and conditions. The deposit is payable in full to Go2NewZealand immediately upon making a booking. The balance of the tour price is payable to Go2NewZealand no later than sixty (60) day’s prior to the tour date. If the full tour price is not received Go 2 New Zealand reserve the right to cancel your tour and retain the deposit paid. A tour booking may be made within the sixty (60) day’s providing full payment is made at the time of the booking.

4.2 Payments may be made by way of Cash, Credit card and direct credit or any other method as agreed between the parties.

4.3 Any expenses, disbursements and legal costs incurred by Go2NewZealand in the enforcement of any rights contained in these terms shall be paid by the customer, including any reasonable solicitor’s fees or debt collection agency fees.

We accept payment by Visa or Mastercard. Please note, payment of balance of fare made by Visa or Mastercard will incur additional fees.

Account transfer:

Payments for deposits or tour balances can be made into local bank accounts in the Czech Republic in EUR or CZK with no additional fees.

5. CANCELLATION

5.1 Go2NewZealand reserves the right to cancel a tour at any time without having to provide a reason. Any cancellation made in this matter will be in good faith and reasonable time.

5.2 Cancellation fees may apply and depend on when Go2NewZealand receives notification of cancellation. For avoidance of doubt any notice of cancellation must be communicated in writing (letter or email) followed by verbal confirmation. Go2NewZealand cancellation fees are as follows:

5.2.1 20% of tour cost for bookings cancelled 60 days’ or more prior to the tour;

5.2.2 50% of tour cost for bookings cancelled 45 - 59 days’ prior to the tour;

5.2.3 75% of tour cost for bookings cancelled 31-44 days’ prior to tour;

5.2.4 100% of tour cost for booking cancelled 0-30 days’ prior to tour.

5.3 Go2NewZealand is not bound to provide any refund for cancellations after the tour has commenced. Any deposit paid is valid only for the dates originally booked, unless otherwise mutually agreed.

6. EQUIPMENT AND LUGGAGE

6.1 Go2NewZealand encourages all customers to travel light. This includes limiting luggage to one medium sized suitcase no heavier than 23kg. All luggage will be stored in a luggage compartment and will not be accessible throughout the duration of the tour. It is advised that you bring a small day pack or soft bag that can be easily stowed on the coach for your rain jacket, sunhat, small personal items, camera and other items.

7. ROOM AND DIETARY REQUESTS

7.1 Special dietary and room requests will be accepted in which such information is passed onto meal suppliers and hotels but cannot be guaranteed.

8. SEATING

8.1 Go2NewZealand has a seat rotation policy to ensure all customers can experience the tour to their fullest extent. All passengers must comply with Go2NewZealand’s seat rotation policy which is a condition of booking. (Does not apply to fully private tours)

9. INSURANCE

9.1 To prevent any loss and to safeguard your tour in the event of cancellation or curtail, Go2NewZealand encourages all participants to take out domestic cancellation insurance at the same time as making a booking as any cancellations received will be charged as per above clause 5.

10. HEALTH, FITNESS AND BEHAVIOUR

10.1 Any deposit payment by customers to Go2NewZealand acts as a warranty and disclosure that each participant is reasonably healthy and is fit for participation in the tour and associated physical activities. Customers further acknowledges, confirms and indemnifies Go2NewZealand from all liability, actions, claims and/or demands arising out of any want of health and fitness. Go2NewZealand at its sole discretion reserves the right to remove a customer from the tour if in their personal opinion reasonably believes that the customers health, fitness or behaviour interfere with the tour or any other customers tour experience.

11. RESPONSIBILITIES

11.1 Go2NewZealand provides a service which includes but is not limited to the booking and packaging of goods and services provided by other organisations such as hotels, attractions and transportation companies. Customers are strongly advised to familiarise themselves with the terms and conditions in which such services are supplied. Go2NewZealand is not responsible and is therefore excluded from liability for any loss, damage, omission or any acts being negligent or otherwise committed by the operators of airlines, coach lines, cruise vessels, hotels or other attractions used in connection with the tours.

12. OPTIONAL TOURS AND GUIDES

12.1 Such excursions are not operated or organised by Go2NewZealand and no person employed or associated with Go 2 New Zealand has any connection with the operators of these excursions. Go 2 New Zealand are not responsible for any action, injury, loss or damage of any type that may arise or result from these excursions.

13. ACCOMMODATION AND ACTIVITIES

13.1 From time to time Go2NewZealand may change/vary the accommodation listed due to availability or other unforeseen circumstances outside of the control of Go2NewZealand. In such circumstances accommodation will be of the same or similar standard based on the best available alternative. If an included activity is unavailable, Go2NewZealand will use its best endeavours to provide an alternative activity of a similar standard and reserves the right to amend/vary an itinerary where necessary.

14. DISPUTES

14.1 Any dispute that may arise is to be dealt with in the law of New Zealand.

15. DOCUMENTATION

15.1 A customer is at their own discretion responsible for the acquisition of passports and appropriate visas, where necessary. Go2NewZealand highly recommends that such documents, as required by the Government, are finalised at least six (6) weeks’ prior to the date of departure.

16. REFUND

16.1 Go2NewZealand is not bound or obliged to provide a refund for any unused portion of any itinerary. Any alteration to the holiday, made by a customer shall be wholly at the expense of that customer.

17. TRANSFERS

17.1 Should a customer have pre or post tour accommodation booked outside of the tour hotels then any airport transfers are not included in a booking.

18. HOLIDAY DURATION

18.1 The first and last day of most structured holidays is considered a travelling day. Therefore depending on flight times may not necessarily be a whole day. Go2NewZealand is not liable for any costs arising out of a customer missing a flight unless as a direct result of the actions of Go2NewZealand.

19. FORCE MAJEURE

19.1 Except where expressly stated in these conditions, Go2NewZealand does not and will not accept liability or be liable to any compensation where the performance of Go2NewZealand’s contractual obligations are prevented or affected by reason of circumstances amounting to “force majeure”. For the avoidance of doubt “force majeure” means any event in which Go2NewZealand or the supplier of the service(s) being offered as part of the tour could not, even with all due care, foresee or avoid. Such events may include war, threat of war, riots, terrorism, civil strife, riots, industrial dispute, natural or unclear disaster, adverse weather conditions, fire and all similar events outside of Go2New Zealand’s control.
